A preview of what's to come (this is currently on the test server):
Death Penalty - When you get incapped (space or ground) you take an Injury. The Injury is either Minor, Major, and Critical. The type of injury you get seems dependent on random chance and whether you currently have any injuries or not (and difficulty slider.) (I hear that it's fairly hard to get a Critical wound unless you're on Elite difficulty.)
There are repair kits for these, a different kit for each type. Injuries affect stats. A minor injury probably won't hurt you much but several major ones will show an effect.
Difficulty Slider - Normal / Advanced / Elite
The higher the difficulty, the harder the NPCs but the loot is better. Group difficulty settings are determined by the team leader's setting. Open groups, PvP, fleet actions, etc are not subject to difficulty settings.

So where does it leave those Enemy Contact actions? More than once I'm on autopilot to a system and I got sucked into an Enemy Contact zone against my will. Once I even saw that red cloud move in my direction and force me to join. If I'm AFK thinking I can grab a drink while I'm going to Memory Alpha or someplace, my ship can be destroyed before I get back. I wouldn't want a death penalty for that!

The death penalty seems pretty light so far, but I have not played it. My hope is eventually we will get sick bays and engineering on our ships that we can do to to heal stuff right there. Untill then, we get repair packs.
As for the question of getting ganked in a DSE, the difficulty slider does not effect those maps. So, at worst you would get killed once on the Standard (easy) setting, which has a very low chance of injury. So aside from annoying, it should not be too serious. (And DSEs will hunt you down...)
